1. Eligibility: The giveaway (the “Sweepstakes”) is open to legal residents of the United States who sign up at the designated online sweepstakes page and meet the age requirements of their respective state at the time of entry. The Sweepstakes is void where prohibited by law. Employees of Herb Affair, its affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members or household members are not eligible to participate. This Sweepstakes is subject to all applicable federal, state, and local laws.
2. Agreement to Rules: By participating in this Sweepstakes, you agree to abide by the rules, confirming that you meet the eligibility requirements. You further agree to accept the decisions of Herb Affair as final and binding regarding the Sweepstakes.
3. Sweepstakes Period: Entries will be accepted online starting from 08/26/2024 and will end on 09/30/2024 at 11:59 PM CST. All entries must be received by this deadline.
4. How to Enter: To enter, you must submit the required form on the sweepstakes page at HerbAffair.com. Entries that are incomplete or do not adhere to the rules may be disqualified at Herb Affair’s discretion. You may only enter once using a single email address. Multiple entries or attempts to use multiple identities may result in disqualification. Fraudulent methods or attempts to circumvent the rules may result in removal from the Sweepstakes.
5. Prizes: The winner will receive one Capsule-It, one bag of 1000 count empty capsules and their choice of any herbal powder available at Herb Affair. Actual/appraised value may differ at the time of the award. No cash or prize substitution is permitted unless at the sole discretion of Herb Affair. The prize is non-transferable, and all prize-related expenses, including taxes, are the responsibility of the winner. By accepting the prize, the winner grants Herb Affair permission to use their name and likeness for promotional purposes without additional compensation, unless prohibited by law.
6. Odds: The odds of winning depend on the number of eligible entries received.
7. Winner Selection and Notification: The winner will be selected randomly under the supervision of Herb Affair. The winner will be notified by email within five (5) days of selection. Herb Affair is not responsible for failed notifications due to spam filters or incorrect contact details. If the winner cannot be contacted, fails to claim the prize within 15 days, or fails to return required forms, the prize may be forfeited and an alternate winner selected.
8. Rights Granted by You: By entering, you grant Herb Affair and its affiliates the right to use your entry, name, likeness, and any statements made about the Sweepstakes for advertising and promotional purposes in any media worldwide, without further compensation, where permitted by law.
9. Terms: Herb Affair reserves the right to cancel, modify, or suspend the Sweepstakes if it encounters issues such as fraud, technical problems, or other circumstances beyond its control that affect the integrity of the Sweepstakes. Herb Affair also reserves the right to disqualify anyone who tampers with the entry process or violates these rules.
10. Limitation of Liability: By entering, you release Herb Affair, its affiliates, and its agents from any liability related to participation in the Sweepstakes, including but not limited to any injuries, damages, or losses.
11. Disputes: The Sweepstakes is governed by the laws of the state of Illinois. Any disputes will be resolved individually in the state of Illinois, without resort to class action, and only actual out-of-pocket costs incurred to enter the Sweepstakes will be recoverable. You waive any right to seek punitive or consequential damages.
12. Privacy Policy: Information submitted is subject to the privacy policy available on the Herb Affair website.
